These Terms and Conditions (“Terms”) govern your use of the Fikefit mobile application (the “App”) and any related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.
Acceptance of Terms
By downloading, installing, or using the App, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this age requirement.
Account Registration
To access certain features of the Services, you may need to create an account. You agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information to keep it accurate, current, and complete.
- Maintain the security and confidentiality of your login credentials.
- Notify us immediately of any unauthorized use of your account.
Use of the Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any manner that could disable, overburden, damage, or impair the App or interfere with any other party’s use of the Services.
- Attempt to gain unauthorized access to any part of the Services or any systems or networks connected to the Services.
- Use any robot, spider, or other automatic devices, processes, or means to access the Services for any purpose.
- Use the Services to collect or harvest personal information about other users without their consent.
- Use the Services to upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Payment and Subscriptions
Some features of the Services require a subscription, available on a monthly basis. By subscribing to or purchasing any paid Services, you agree to pay all applicable fees and taxes. All payments are non-refundable except as required by law.
Health and Medical Disclaimer
Fikefit provides health and personal training, diet, and workout programs. However, it is not a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before starting any exercise program or making any changes to your diet or exercise routine. Use of the Services is at your own risk.
Intellectual Property
All content and materials available through the Services, including but not limited to text, graphics, logos, images, and software, are the property of Fikefit or its licensors and are protected by intellectual property laws. You agree not to copy, modify, distribute, create derivative works from, or otherwise exploit the content or materials without our prior written consent.
Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
Limitation of Liability
To the fullest extent permitted by law, Fikefit and its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Services.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any interruption or cessation of transmission to or from the Services.
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Services by any third party.
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
